TICKETING TERMS & CONDITIONS
This message is important and must be read by all customers who have purchased a Ticket(s) to attend THE BORNEO SONIC MUSIC FESTIVAL. Purchasing or pre-registering to purchase a Ticket(s) to THE BORNEO SONIC MUSIC FESTIVAL implies that the customer has read, understood and agreed to accept the terms and conditions below before attending THE BORNEO SONIC MUSIC FESTIVAL. By purchasing a Ticket(s) to THE BORNEO SONIC MUSIC FESTIVAL, the customer agrees they have accepted and agreed to the following terms and conditions.
DEFINITION
“Ticket(s)” shall be defined as any valid Ticket(s) that permits a customer to have the right of admission into THE BORNEO SONIC MUSIC FESTIVAL (“the Event“) or any valid wristband for which the customer has exchanged the Ticket(s) upon entry. Ticket(s) to the Event are sold by and on behalf of BME International (Malaysia) Sdn. Bhd. (“the Event Organiser“), who reserves the right to change all or any arrangements concerning the Event without notice, nor with any obligation whatsoever to refund.
In the event a customer acts an agent to any other person or persons in obtaining the Ticket(s), the customer (agent) recognises that s/he is acting as that person's or persons' agent (“the Principal”) in obtaining the Ticket(s), and due to this agency relationship, the customer (agent) agrees to these terms and conditions for and on behalf of the Principal to whom the customer (agent) delivers any of the purchased Ticket(s) and the customer shall notify the Principal of these terms and conditions when the Ticket(s) is or are delivered. The Ticket holder shall be deemed to have read, understood and agreed to these terms and conditions.
"The Event" shall be defined as the event called THE BORNEO SONIC MUSIC FESTIVAL which is held at the venue in respect of which the customer has bought the Ticket(s).
“The Venue” shall be defined as the venue where the Event is held.
“The Event Organiser” shall be defined as BME International (Malaysia) Sdn. Bhd. who are responsible for producing, organising and operating the Event.
“KARUNA” shall be defined as KARUNA (SARAWAK) ENTERPRISE SDN. BHD. (Company No. 972491-T) of No. 67, Lot 10210, 3rd Floor, Jalan Tun Jugah, 93350 Kuching, Sarawak who are the sole and exclusive authorised agent of the Event Organiser.
USE OF THE TICKET(S)
All Ticket(s) sold are final. Ticket(s) are not allowed to be cancelled, refunded for cash nor will exchanges be made under any circumstances except if and only if the Event is cancelled or postponed by the Event Organiser and/or KARUNA and in such case, refunds (if any) are subject to the Event Organiser's and/or KARUNA's terms & conditions. In the event of an official cancellation, Ticket(s) refund nett of Ticket(s) fee will be granted. Credit/Debit card charges are not refundable. A processing fee of 2.5% of the Ticket Price shall be charged of which is non-refundable.
Any persons under 12 years of age are strictly not allowed to attend. Any person under the age of 18 must be accompanied by an adult or persons aged 18 years old and above.
All Ticket holders are required to redeem their Ticket(s) for the Event's wristbands in order to gain entry to the Event. An electronic ticket, printed or digital, does not entitle entry into the Venue. The wristband must be worn at all times during the Event and those found without the wristband shall be evicted from the Venue.
For 2-Day Pass Ticketholders, the same wristband must be worn at the Venue on both days of the Event and Ticketholders are responsible for their own wristbands. Ticket holders who loses their Ticket(s) and/or wristband at the Event shall be evicted from the Venue and are required to repurchase a Ticket(s) at an additional RINGGIT MALAYSIA TWO HUNDRED ONLY cost for re-entry to the Venue.
All Ticket holders are subject to body and/or bag checks at all entry points into the Venue.
Ticket holders are required to produce the following at the wristband redemption counter in order to redeem their wristband(s):
- The electronic ticket(s) in print or digital form; and
- A copy of the Ticket holder's valid photo ID or passport matching the name reflected on the respective Ticket(s).
The Event Organiser and/or KARUNA may refuse entry to Ticket holders of Ticket(s) that the Event Organiser and/or KARUNA have reasons to believe are not genuine, not purchased or acquired from unauthorised agents, or damaged.
The re-sale or use of any Ticket(s) by any third parties in connection with other offers and promotions of the Ticket(s) without the prior authorisation or written consent by the Event Organiser and/or KARUNA is strictly prohibited.
The Event Organiser and/or KARUNA reserves the right to cancel any Ticket(s) that have been re-sold or used by any third parties in connection with other promotions, without a refund and the holder of such Ticket(s) shall be refused entry into the Venue.
The Event Organiser and/or KARUNA reserves the right to add, withdraw or substitute any artists and/or vary the advertised programs, Event times and audience capacity without any prior notice and/or compensation to the Ticket holder.
The Event Organiser and/or KARUNA may postpone, cancel, interrupt and/or stop the Event due to adverse weather, dangerous situations, or any other causes beyond their reasonable control.
The Ticket holder shall observe and comply with all Event rules, prohibitions and directions given by authorised personnel of the Event Organiser and/or KARUNA, including but not limited to submitting to any search; and voluntarily assume all risk and danger incidental to the event whether occurring prior to, during, or subsequent, to the event, including but not limited to deaths, personal injuries, losses, damage and/or liability.
The Event Organiser and/or KARUNA reserves the right to refuse entry and/or evict from the Venue any person or persons with unruly conduct and/or in breach of any Venue and/or ticketing terms & conditions.
Ticket holders are responsible for checking all Event information and ensuring that the right Ticket has been purchased for the right Event on the specific date(s). No refunds will be processed if Ticket holders mistakenly purchase a Ticket to the wrong city, wrong Ticket allocation, wrong Ticket package, seating location or make any other error in connection with the Ticket purchase.
If the Event is rescheduled for any reason whatsoever, the Ticket(s) shall remain valid or if applicable, new Ticket(s) will be reissued for the rescheduled Event, unless otherwise advised by the Event Organiser and/or KARUNA.
Near Field Communication Top-up Policy
Ticket holders are required to top-up a minimum of RM30.00 into their online account of which can be done by logging into their online account or at KARUNA's top-up counters at the Venue. The top-up counters accepts debit cards/credit cards ONLY.
Near Field Communication Refund Policy
There shall be a period of fifteen (15) days after the Event where Ticket holders are able to request for a refund of their Near Field Communication Wristband credit balance subject always to the following:-
- A Ticket holder with a credit balance of less than RM20.00 shall not be entitled to a refund.
- A Ticket holder with a credit balance of RM20.00 or more is eligible for a refund subject to a refund fee of 15% of the total balance which shall be automatically deducted from the Ticket holder's balance.
- Any unclaimed balance and/or amount less than RM20.00 in the Ticket holder's online account shall be transferred to the Event Organiser after fifteen (15) days from the Event less the 15% refund fee.
Ticket holders shall indemnify KARUNA against all losses, expenses, damages, claims incurred directly or indirectly from the Event.
The Ticket holder grants the Event Organiser and/or KARUNA the right to include the Ticket holder's image, likeness, actions, and statements in any live or recorded audio, video, film, webcast, stream, or other transmission, exhibition, simulcast, or reproduction made of, or at, the Event in any medium or context for any purposes, including but not limited to commercial or promotional purposes, without further authorization or otherwise.
The Event Organiser and/or KARUNA retains all webcast/Internet rights to the Event. Any live streams or broadcasts, whether on the Internet or otherwise, from the Event must be specifically agreed to in advance with the Event Organiser and/or KARUNA. No one may transmit, broadcast, or communicate any live audio or audiovisual images from the Event site without the Event Organiser's and/or KARUNA's prior written permission. Even if the Ticket holder is a performer or sponsor, the broadcasting, displaying, or communicating any live audio or audiovisual images (whether for personal, commercial, or other use) is expressly prohibited, without the prior written permission of the Event Organiser and/or KARUNA .
Strictly NO professional photography, video and/or audio recording of any sort is permitted during the Event.
Ticket holders may bring personal, non-commercial, photography devices into the Event and may use these devices to obtain short-form videos and/or still photographs. For example, personal, non-commercial, photography and/or video devices include, but are not limited to, cell phones, small digital or film cameras (without a detachable lens).
Ticket holders hereby consents to have medical treatment that may be deemed advisable in the event of an injury, accident, and/or illness during the Event and affirmatively releases the Event Organiser and/or KARUNA and all persons participating in such medical treatment from all responsibilities for any such actions.
No sponsorship, on site marketing, sampling, vending, coupon/product distribution, or other promotional/advertising activity may be conducted at the Event (inclusive of parking lots) without the Event Organiser's and/or KARUNA's prior written approval in such instances.
No outside foods and/or beverages are allowed into the Venue.
Drugs, weapons or any dangerous item are strictly prohibited.
The Event is a rain or shine event.
LIABILITY
Ticket holders agree that the Event Organiser and/or KARUNA shall not be held responsible, financially or otherwise, for any personal properties that are left, lost, stolen, destroyed, confiscated, damaged and/or misplaced anywhere at the Venue or during the Event, regardless of fault or reason.
Ticket holders agree and are aware that certain contents of the Event are intended for mature audiences only.
The Event Organiser and/or KARUNA reserves the right to limit access to any stage to prevent hazardous overcrowding. Ticket holders agree that the Event Organiser and/or KARUNA, its servants or agents shall not be liable for any losses, injuries or damages to any person or persons or properties however caused (including by the Event Organiser and/or KARUNA or its servants or agents):
- in any circumstances unless due to the negligence of the Event Organiser,;
- in circumstances where such losses, injuries or damages are not a reasonably foreseeable as a result of any such breach (save for deaths or personal injuries due to the negligence of the Event Organiser); and/or
- to the extent that any increase in any losses, injuries or damages results from the breach by the Ticket holder of any of these terms and conditions. For the purposes of these terms and conditions, "Force Majeure" means any circumstances beyond the Event Organiser's control including but not limited to, an act of God, war, insurrection, riot, civil disturbances, acts of terrorism, fire, explosion, flood, National Ceremony, theft of essential equipment, malicious damage, strike, lock out, weather, third party injunction, national defence requirements and/or acts or regulations of national or local governments. The Event Organiser shall not be liable for failure to perform any obligation under these terms and conditions to the extent that such failure is caused by Force Majeure.
Ticket holders agree that the Event Organiser and/or KARUNA shall not be liable for any indirect or consequential costs, claims, actual or alleged losses howsoever arising out of or in connection with the Event and/or the Event Organiser's and/or KARUNA's obligations hereunder including, but not limited to, loss of profits, anticipated profits, savings, business or opportunity, or loss of publicity or loss of reputation, or opportunity to enhance reputation, or loss of contract or other economic or consequential loss arising from the performance (or any failure to perform) these terms and conditions.
The Event Organiser and/or KARUNA shall not be liable to the Ticket holders for whatsoever losses and/or expenses incurred in connection with the Event or any cancellation of the Event, including but not limited to, costs of any personal travels, accommodations or hospitality arrangements made relating to the Event or the cancellation of the Event.
The Event Organiser and/or KARUNA shall not be liable for any acts and/or omissions of any operators at the Venue, for any personal injuries suffered at the Venue (unless due to the acts or omissions of the Event Organiser) or any losses, thefts or damages to properties at the Venue (unless due to the act or omissions of the Event Organiser) or caused by any impropriety of the Event Organiser.
The Event Organiser and/or KARUNA accepts no responsibility and/or liability for any personal properties. Please do not bring unnecessary valuable items or excessive amounts of cash.
