TERMS AND CONDITIONS

• Farm Fresh @ UPM is solely operated by Farm Fresh Agro Tourism Sdn Bhd (FFATSB), a subsidiary owned and operated by Farm Fresh Berhad. This dairy farm is also established as the Industry Centre of Excellence together with University Putra Malaysia.
• By entering Farm Fresh @ UPM, visitors consent to these terms and conditions (which also incorporate the privacy notice available at Receive service requests from users/customers via various channels) (“these T&C”). Adults (aged 18 years and above) bringing minors to Farm Fresh UPM represent that they have the authority to agree that these T&C apply to such minors and hereby indemnify FFATSB against any claim by the minor or his/her parent or legal guardian arising from such representations being false.
• It is mandatory for customers to present both their valid identification card (IC) and Annual Pass together at the point of entry to gain unlimited access to Farm Fresh @ UPM. This entitlement is valid for one year, starting from the date of purchase.
• Admission is subject to Farm Fresh @ UPM's operating hours (which may change from time to time without prior notice) and capacity limitation.
• The annual pass is non-refundable, non-transferable, non-replaceable if lost or stolen, not for resale, and will be deemed invalid if altered or damaged
  FFATSB do not entertain of any refunds due to bad weather (heavy raining, lightning, heat waves etc.).
• Children below the age of 10 must be accompanied by an adult at all times when inside Farm Fresh @ UPM. For proper care and attention while at Farm Fresh @ UPM, it is recommended that each adult accompanies no more than 5 kids.
• Children between the age of 10 and 17 years are allowed without being accompanied by an adult, but an adult must be present for the children at point of drop off & pick up.
• Children below the age of 4 years will be allowed to Farm Fresh @ UPM for free. FFATSB may require accompanying adults to provide proof of identification of their children at any time during the visit at Farm Fresh @ UPM.
• OKU or special needs individuals will be allowed to enter Farm Fresh @ UPM for free. FFATSB may require accompanying adults to provide proof of identification of their children at any time during the visit at Farm Fresh @ UPM.
• OKU or special needs individuals must be accompanied by their parents, guardians, or assistant.
• Everyone is to read the house rules and understand the nature of how this farm operates and abiding by the rules & regulations of the place.
  Be aware of certain signages to guide you with more info / direction on where to go and how to care for the flora & fauna of the place.
• By entering Farm Fresh @ UPM, visitors accept that they have a duty to take reasonable steps to ensure their own safety & security of their belongings and, taking into account any personal medical conditions. All visitors in and around Farm Fresh @ UPM should behave in a safe manner at all times and accompanying adults shall exercise reasonable steps in supervising the kids.
• Upon admission, each visitor will be required to show or carry their annual pass. For re- entry, safety, and security purposes, the annual pass must be kept with the visitor at all times within Farm Fresh @ UPM until leaving the premises.
• FFATSB may conduct security checks on visitors’ belongings at any time.
• FFATSB may, without refund or compensation, refuse admission to, or remove from Farm Fresh @ UPM, any visitor who contravenes these T&C.
• All persons entering these premises, or using any amenities or facilities on these premises, do so entirely at their own risk and subject to the following conditions:
  1.These premises are private property and the owner, Manager and/or Operator of these premises reserves the right to refuse admission or entry to any person.
  2.These Premises may be monitored by CCTV surveillance.
  3.The Owner, Manager and/or operator of these premises, amenities and facilities and its directors, officers, employees, agents and representatives, do not accept any liability whatsoever for any injury or death of any person or the loss or destruction of or damage to any property, arising from fire, theft or any other cause whatsoever and by whomever caused or arising from the negligence or gross negligence or wrongful acts or omissions of the owner, manager and/or operator of the farm or its directors, officers, employees, agents and representatives.

• The Acre by Farm Fresh does not warrant or represent that your access to the Service will be uninterrupted or error-free or that any information, data, content or other material accessible in connection with the Service will be accurate or free of computer viruses, bugs or other harmful components.
• The Service is provided "as is" without warranties of any kind and The Acre by Farm Fresh disclaims all warranties, whether express or implied, to the maximum extent permitted by law, including but not limited to warranties as to fitness for purpose, non-infringement of intellectual property or proprietary rights or compatibility between the Service and any software or hardware.
• You accept all risk and responsibility for your use of the Service including the submission of any personal or financial information.
• The Acre by Farm Fresh, their managers and employees shall not be liable for, and shall exclude to the maximum extent permitted by law, any liability, loss, claim or damage which arises out of or is in any way connected with any of the following:
  I.your access to or use of the Service;
  II.your use of or reliance on the information or materials provided in connection with the Service;
  III.your supply of any personal or financial information or the unauthorised access thereof by a third party;
  IV.the unavailability of the Service or any failure, delay or error in processing or fulfilling a reservation or reservation request; and
  V.the use of the restaurants or consumption of the food, beverage or restaurant services by you or any other person.
• The Acre By Farm Fresh, their managers and employees shall not be liable for any indirect, consequential, incidental or special loss, including loss of revenue, income, profit, opportunity or reputation arising out of your use of the Services, Website or restaurants.
• You agree to indemnify and keep The Acre by Farm Fresh, their managers and their employees indemnified from and against any liability, loss, claim or damage which arises out of or is caused by your breach of these terms and conditions and/or your use of the Service, Website or restaurants.
