  1. The Carey Heritage Ride (the “Event”) is organised by SD Guthrie Berhad (the “Organiser”) in accordance with these T&C details stipulated in the Event page at www.ticket2u.com.my, and all relevant laws and regulations which are applicable to the participants of the Event (“Participant” or “Participants”).
  2. For the purposes of this Event, the collection, use, disclosure, and management of any personal or other information provided by Participants will be governed by the Organiser’s Privacy Policy available at www.sdguthrie.com/privacy-notice. Participants are expected to read and understand the Privacy Policy which details the Organiser’s practices regarding the handling of personal information in compliance with applicable data protection laws. By participating in the Event, Participants agree to the terms of this Privacy Policy, which forms an integral part of these T&C.
  3. The Organiser reserves the right to modify or substitute any of these T&C and the Privacy Policy from time to time at its sole discretion without prior notice to the Participants. If there is ambiguity in any of the provisions, the Organiser shall be the authority to interpret and in doing so, the Organiser will take into account the interests of all the affected Participants. It is incumbent upon each Participant to periodically review these documents to ensure compliance with the current terms of participation and the Organiser shall not be held liable otherwise.
  4. For the purpose of this Event, the Participants agree to:
    • Provide true, accurate, current and complete information contained in any registration form (such information being the “Registration Data”);
    • Maintain the security of the Participant’s password and identification; and
    • Maintain and promptly update the Registration Data to keep it true, accurate, current and complete. The Organiser may contact the Participants from time to time by email and/or mobile device. Any notice sent to the email address and mobile device registered with the Organiser shall be deemed as received by the Participants. If the Participants provide any information that is untrue, inaccurate, not current or incomplete, or the Organiser has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, the Organiser may suspend or terminate the Participant's registration in the Event.  
  5. The Organiser reserves the right to cancel or postpone the Event at any time without prior notice to the Participants. In such cases, the Organiser shall endeavour to use reasonable efforts to inform Participants prior to the date of the Event. The Organiser shall not be held liable for any loss or inconvenience caused due to such changes.
  6. In the event of any cancellation or postponement, refunds will not be issued, except under exceptional circumstances at the discretion of the Organiser. There will be strictly no refund available if the Event is cancelled for reason of force majeure events i.e., due to occurrence of incidents that are beyond the control of the Organiser or acts of God which renders it impossible or unsafe to hold the Event.
  7. The Organiser reserves the right to amend the Event format and/or ride routes (“Routes”) stipulated in the Event page at www.ticket2u.com.my as the Organiser deems fit for the safety of the Participants and/or to prevent any potential hazards in the running of the Event, at any time. In such cases, the Organiser shall use reasonable efforts to inform the Participants prior to the date of the Event. The Organiser and its Affiliates shall not be held liable for any loss or inconvenience caused due to such changes.
  8. The Organiser reserves the right to use any photographs (including those of Participants), motion pictures, recordings, or any other media records of the Event including any program(s), event(s), talk(s), demonstration(s), or any other activities associated before, during or after the Event, for any legitimate purpose including commercial advertising and publicity purpose.
  9. The Organiser reserves the right to limit and/or refuse entry to the Event and/or other program(s), event(s), talk(s), demonstration(s), or any other activities related to Event and involving the Organiser without giving any reason and/or notice.
  10. While every reasonable precaution will be taken by the Organiser to ensure the safety of Participants, the Participants take part solely at their own risk and the Organiser shall not be responsible or held liable for any injury, damage, contraction of communicable disease, death or any other loss howsoever arising from training for, before, during, or after participation in the Event, to the extent permitted by law. Participants are advised to undergo a medical examination and consult a medical practitioner to ensure they are fit for their participation in the Event. By extension, the Organiser shall also not be held liable for any injury, damage, contraction of communicable disease, death or any other loss howsoever suffered by any person(s) attending the Event with the Participants, to the extent permitted by law.
  11. The Organiser reserves the right to remove any participant whom in the Organiser’s sole opinion, is guilty of jostling, obstructing or involves in act of aggression against another.
  12. The Organiser reserves the right to remove any participant whom in the Organiser’s sole opinion, physically unfit or appears to be unfit or incapable of continuing/completing the Route. The organiser also reserves the right to remove riders in the interest of time management, traffic conditions, weather conditions and route conditions.
  13. Completion of the registration form confirms the Participant’s agreement to abide by these T&C and the Privacy Policy.
  14. Registration for the ride is only confirmed upon payment made and upon issuance of the Participant’s ride identification number.
  15. Once registration has been duly processed, there will be strictly no refunds after payment is made, for any reason whatsoever. There will be strictly no refunds for Participants who do not eventually take part in the Event for whatever reason.
  16. The Organiser shall not in any way be responsible for any disputes arising from incomplete or inaccurate entry details in the registration form.
  17. Only 1 entry is allowed for each Participant. Change of category is not allowed once registration has been completed.
  18. Participants are strictly prohibited from swapping, transferring, selling, or allowing any other person to use his/her handlebar plate, unless approved by the Organiser.
  19. If the Participant's original handlebar plate cannot be found by the respective staff during Ride Kit Collection (“RKC”), the Organiser reserves the right to replace it with a spare handlebar plate. The Organiser reserves the right to amend or substitute any Participant’s handlebar plate at any time without prior notice to the Participant.
  20. The Ride Kit includes a ride jersey (for 100KM category) or T-shirt (for 45 KM and 20KM categories), handlebar plate, and other sponsored items (if any).
  21. Participants must collect their Ride Kits at SD Guthrie Tower, Ara Damansara at the stipulated collection period, of which details will be stated on the Event page at www.ticket2u.com.my.
  22. All Ride Kits not collected during collection period will be deemed to be unwanted, and the Organiser shall be at liberty to dispose or re-distribute them accordingly. Ride Kits cannot be collected on the day of the Event.
  23. Participants must attach the assigned handlebar plate on the front of his/her handlebar. The handlebar plate must be clearly displayed on the handlebar at all times. No Participants shall be allowed to start the ride nor take part in the Event without displaying the appropriate handlebar plate and/or identification.
  24. It is the responsibility of the Participants to ensure that his/her handlebar plate is not covered with a jacket, pouch bag, his/her arms, or any other object when cycling. The Organiser reserves the right to disqualify any Participant who does not use his/her assigned handlebar plate during the ride.
  25. Any Participant who commences to ride before the actual flag-off of his/her registered ride category will be immediately disqualified. The start time for the respective ride categories can be found on the Event page at www.ticket2u.com.my.
  26. Participants who do not start within 20 minutes of respective flag-offs, for safety reasons may not be allowed to start and will be immediately disqualified.
  27. A Participant must retire from the ride immediately, if required to do so by any member of the official medical staff, the ride director, and/or security officer. The Organiser shall not be responsible or held liable for any injury, damage, contraction of communicable disease, death or any other loss howsoever suffered by the Participants who refuse to retire when required to do so by the official medical staff, the ride director, and/or security officer.
  28. There are 3 distance categories as follows:
    • 100KM (Challenge Ride) - 18 years old and above as of Event Day.
    • 45KM (Standard Ride) - 18 years old and above as of Event Day.
    • 20KM (Fun Ride) - Those 13 to 18 years old are to be accompanied by guardians during the Ride. 
  29. Throughout the Ride, Participants must obey the following rules:
    • Participants must obey all traffic rules and instructions
    • Ride in a single file and not obstruct other road users
    • Wear a helmet and to switch on blinkers throughout the ride
    • Complete the ride by the cut-off time of 1.30 p.m.
  30. There are no winners nor prizes for all categories.
  31. Participants are advised to pack light and avoid from bringing valuable items to the Event.
  32. The Organiser shall not be responsible for any loss and/or damage, personal or otherwise, to the personal belongings and items brought to the Event by the Participants and by extension any person(s) attending the Event with the Participants.
  33. The Organiser also reserves the right to conduct reasonable inspection on any item or bag for security purposes.
  34. By registering for the Event, Participant agrees that the Organiser has the right to post the full ride results on any publication deemed suitable by the Organiser including website and social media platforms after the Event.
  35. The Organiser’s decision on all matters relating to the event shall be final and binding and no further correspondence or attempt to dispute such decision will be entertained.
