GENERAL ADMISSION LIABILITY WAIVER, RELEASE OF LIABILITY & ASSUMPTION OF RISK
IMPORTANT LEGAL AGREEMENT
PLEASE READ CAREFULLY BEFORE PURCHASING A TICKET.
By purchasing, receiving, possessing, or using a ticket to attend the Project Midnight Gymkhana & Chill event ("Event"), you acknowledge that you have read, understood, and voluntarily agreed to all terms contained in this Liability Waiver and Release Agreement.
If you do not agree with these terms, DO NOT purchase or use a ticket.
1. DEFINITIONS
Throughout this agreement:
"Organiser" includes:
2. ACKNOWLEDGEMENT OF DANGEROUS ACTIVITIES
I understand that this Event involves inherently dangerous motorsport-related activities including but not limited to:
I acknowledge that these risks cannot be completely eliminated.
3. ASSUMPTION OF RISK
I voluntarily assume ALL risks associated with attending the Event including risks that may result in:
Minor injury
Serious injury
Permanent disability
Death
Property damage
Vehicle damage
Theft
Fire
Emotional distress
Economic loss
Whether caused by participants, spectators, weather, other attendees or otherwise.
I attend entirely at my own risk.
4. RELEASE OF LIABILITY
To the fullest extent permitted by Malaysian law, I release, waive and forever discharge the Organiser from any and all liability arising from:
Personal injury
Death
Property damage
Vehicle damage
Loss of belongings
Medical expenses
Hospital bills
Loss of income
Business losses
Consequential losses
Indirect losses
Emotional distress
Psychological distress
Any other damages whatsoever.
This applies regardless of whether the incident occurs:
Before the event
During the event
After the event
Within the venue
In parking areas
Entry roads
Exit roads
Public viewing areas
Food areas
Restrooms
Spectator areas
Or any other location associated with the Event.
5. VEHICLE-RELATED RISKS
I acknowledge that vehicles participating in the Event may:
Lose control
Spin
Skid
Collide
Suffer mechanical failure
Leak fluids
Catch fire
Throw stones
Throw debris
Leave the designated course
I understand there is always a possibility that motorsport incidents may occur despite reasonable safety measures.
6. SPECTATOR RESPONSIBILITY
I agree to:
Remain within designated spectator areas.
Obey marshals immediately.
Respect all barriers.
Not enter restricted zones.
Not interfere with vehicles.
Not distract drivers.
Keep children supervised.
Not climb barriers or fencing.
Follow emergency instructions immediately.
Failure to comply may result in immediate removal without refund.
7. NO RESPONSIBILITY FOR PERSONAL PROPERTY
The Organiser accepts no responsibility whatsoever for:
Lost property
Stolen property
Damaged property
Vehicle theft
Vehicle damage
Helmet theft
Camera damage
Mobile phones
Wallets
Keys
Jewellery
Cash
Clothing
Any personal belongings.
8. FOOD & BEVERAGE
Food and beverages may be sold by independent vendors.
The Organiser makes no warranties regarding:
Food quality
Food safety
Allergens
Preparation
Freshness
Hygiene
Nutritional information
Cross-contamination
Dietary suitability
Consumption is entirely at the attendee's own risk.
The Organiser shall not be liable for:
Food poisoning
Allergic reactions
Illness
Choking
Burns from hot food or beverages
Any medical complications.
9. WEATHER
The Event may proceed despite:
Rain
Heat
Humidity
Strong sunlight
Wind
Smoke
Dust
Poor air quality
The Organiser is not responsible for weather-related injuries or discomfort.
10. PHOTOGRAPHY & MEDIA RELEASE
I grant Project Midnight unrestricted permission to:
Photograph me
Film me
Record my voice
Capture my vehicle
Capture my likeness
Use my image
Use my vehicle
Use my voice
Use my social media posts relating to the Event
For:
Advertising
Marketing
Social media
Future promotions
Commercial purposes
Without compensation.
I waive any rights to inspect or approve the final materials.
11. MEDICAL EMERGENCIES
Should I become injured or require medical treatment:
I authorize emergency medical assistance.
I accept full responsibility for all medical expenses.
The Organiser has no obligation to provide medical treatment beyond reasonable emergency response arrangements.
12. ALCOHOL & DRUGS
Any person appearing intoxicated or under the influence of illegal drugs may be:
Denied entry
Removed immediately
Reported to authorities where appropriate
No refund will be provided.
13. CHILDREN
Parents or legal guardians assume full responsibility for minors attending the Event.
Children must remain supervised at all times.
The Organiser accepts no responsibility for unattended minors.
14. RIGHT TO REMOVE ATTENDEES
The Organiser reserves the absolute right to refuse entry or remove any person for:
Unsafe behaviour
Aggressive conduct
Harassment
Failure to follow marshal instructions
Illegal activities
Damage to property
Disruptive behaviour
No refund will be issued.
15. FORCE MAJEURE
The Organiser shall not be liable for cancellation, postponement or interruption caused by events beyond reasonable control including:
Extreme weather
Natural disasters
Government orders
Pandemics
Civil unrest
Power failures
Venue issues
Equipment failures
Emergencies
16. INDEMNITY
I agree to indemnify and hold harmless the Organiser against any claims, lawsuits, liabilities, damages, legal fees, costs or expenses arising from:
My actions
My negligence
My guests
My property
My violation of Event rules
Damage I cause to others.
17. NO GUARANTEE OF SAFETY
While reasonable safety measures will be implemented, the Organiser cannot guarantee:
Absolute safety
Accident-free conditions
Freedom from injury
Freedom from property damage
Freedom from criminal acts of third parties.
18. GOVERNING LAW
This agreement shall be governed by the laws of Malaysia.
Any disputes shall be subject to the exclusive jurisdiction of the Malaysian courts.
19. SEVERABILITY
If any provision of this agreement is held invalid or unenforceable, all remaining provisions shall remain in full force and effect.
20. ENTIRE AGREEMENT
This waiver constitutes the entire agreement between the attendee and the Organiser relating to liability and risk.
21. TICKET PURCHASE CONFIRMATION
By purchasing, accepting, possessing or using this ticket, I confirm that:
I am at least 18 years old, or I am attending under the supervision and responsibility of my parent or legal guardian.
I have carefully read this Liability Waiver.
I fully understand its contents.
I understand I am giving up certain legal rights.
I voluntarily agree to all terms.
I attend the Event entirely at my own risk.
