EVENT REGISTRATION TERMS AND CONDITIONS
1. Acceptance of Terms
By registering for, making payment for, accepting a race entry to, collecting a race pack for, or participating in the Event, the participant confirms that they have read, understood and agreed to be bound by these Terms and Conditions, the Event rules and any lawful instructions issued by the Organiser.
Where the participant is under the age permitted for independent registration, the registration must be completed or approved by a parent or legal guardian. The parent or legal guardian shall be deemed to have accepted these Terms and Conditions on behalf of the minor participant.
For the purposes of these Terms and Conditions, “Organiser” means the organiser of the Event and its authorised representatives, event management personnel and appointed service providers where applicable.
“Event” means the event for which the participant has registered, including any postponed, rescheduled, relocated, revised or replacement version of that event.
2. Registration
Registration is confirmed only after:
the registration form has been properly completed;
all required participant information has been provided; and
full payment of the applicable registration fee has been successfully received.
Submission of a registration form without successful payment does not guarantee an entry.
The Organiser reserves the right to limit participant numbers, close registration early, reject incomplete registrations or refuse registration where reasonably necessary for safety, operational, regulatory or event-management purposes.
The participant is responsible for ensuring that all information submitted during registration is true, accurate, current and complete.
The Organiser shall not be responsible for problems resulting from incorrect information provided by the participant, including incorrect name, identification details, contact information, shirt size, category, emergency contact or delivery information.
3. Registration Fees
All registration fees and applicable charges must be paid using the payment methods made available by the Organiser or its appointed registration platform.
The participant is responsible for checking the total amount payable before completing payment.
Payment gateway fees, platform fees, booking fees, administrative fees, delivery charges and other third-party charges may be separately imposed where disclosed during registration.
4. STRICT NO REFUND POLICY
ALL REGISTRATION FEES ARE STRICTLY NON-REFUNDABLE ONCE PAYMENT HAS BEEN SUCCESSFULLY COMPLETED, EXCEPT WHERE THE EVENT IS FORMALLY CANCELLED BY THE ORGANISER AND NO POSTPONED, RESCHEDULED, RELOCATED OR REPLACEMENT EVENT IS PROVIDED.
No refund, credit, compensation, reimbursement or exchange will be provided because of:
a participant's change of mind;
inability to attend;
work commitments;
scheduling conflicts;
illness or injury;
pregnancy;
personal or family circumstances;
transportation problems;
flight or travel disruption;
accommodation problems;
visa or immigration issues;
failure to arrive at the Event;
failure to collect the race pack;
failure to participate after registration;
arriving late;
being unable to complete the Event;
disqualification;
refusal of entry resulting from breach of these Terms and Conditions or Event rules;
dissatisfaction with weather conditions;
a change of Event date;
a change of Event time;
a change of flag-off time;
a change of Event venue or location;
a change of starting or finishing location;
a change of route;
a change of race distance;
a change of programme;
a change of activities;
a change of Event format;
a change of race category;
a change in Event facilities, services or arrangements;
postponement or rescheduling of the Event; or
any other Event modification where the Event continues to be held in a revised, postponed, relocated or replacement form.
A participant's inability or unwillingness to attend a revised date, time, venue, location or Event arrangement does not by itself entitle the participant to a refund.
This clause is subject to any rights or remedies that cannot lawfully be excluded or limited under applicable Malaysian law.
5. ORGANISER'S RIGHT TO CHANGE THE EVENT
The Organiser reserves the right, where reasonably necessary for safety, operational, logistical, regulatory, security, venue, weather, public-health or other legitimate event-management reasons, to change, modify, postpone, reschedule, relocate, shorten, extend, suspend or otherwise alter any part of the Event.
This includes, without limitation, the right to change:
the Event date;
Event day;
flag-off time;
reporting time;
cut-off time;
Event duration;
venue;
location;
assembly area;
starting point;
finishing point;
route;
race distance;
category;
wave or starting group;
programme;
schedule;
Event format;
activities;
entertainment;
facilities;
services;
race-pack arrangements;
collection arrangements;
Event partners, sponsors or vendors; and
any other Event arrangement reasonably necessary for the proper conduct of the Event.
The Organiser may relocate the Event to another venue or location considered reasonably suitable for the Event.
The Organiser may also shorten, reroute, divert or otherwise modify the course before or during the Event if required for safety, weather, traffic, road conditions, government requirements, emergency response or operational reasons.
Any such modification shall not, by itself, constitute cancellation of the Event.
6. POSTPONEMENT, RESCHEDULING AND RELOCATION
If the Organiser postpones, reschedules or relocates the Event, the participant's registration will automatically remain valid and will be carried forward to the revised Event.
Unless otherwise decided by the Organiser, participants will not be required to pay another registration fee to participate in the revised Event under the same registration.
Postponement, rescheduling or relocation of the Event shall not constitute cancellation and shall not create any automatic right to a refund.
This applies even where the participant:
cannot attend the new date;
does not wish to attend the new venue;
has conflicting commitments;
has already made travel or accommodation arrangements;
has incurred transportation or other personal expenses; or
otherwise chooses not to participate in the revised Event.
The Organiser will use reasonable efforts to notify registered participants of material changes through its official communication channels.
Participants are responsible for checking official Event announcements and ensuring that their contact information remains current.
7. EVENT CANCELLATION AND REFUND
For the purpose of these Terms and Conditions, the Event is considered “Cancelled” only when the Organiser officially announces that the Event will no longer take place and does not provide a postponed, rescheduled, relocated or replacement Event for which the participant's registration remains valid.
If the Event is formally cancelled in this manner, registered participants will be entitled to a refund of the registration fee actually paid and received by the Organiser, subject to applicable Malaysian law.
Where permitted by law, the refund may exclude separately disclosed:
where those amounts were not retained by or are not recoverable by the Organiser.
The Organiser will announce the applicable refund procedure, required information and submission deadline through its official communication channels.
Where reasonably possible, refunds will be processed using the original payment method.
Participants are responsible for providing complete and accurate information required to process any refund.
No refund will be payable merely because the Event has been postponed, rescheduled, relocated or modified.
8. FORCE MAJEURE AND CIRCUMSTANCES BEYOND THE ORGANISER'S CONTROL
The Organiser may postpone, reschedule, relocate, modify, shorten, suspend or otherwise alter the Event where reasonably necessary because of circumstances including, without limitation:
severe weather;
thunderstorms;
heavy rain;
flooding;
landslides;
haze or poor air quality;
extreme heat;
natural disasters;
fire;
epidemic, pandemic or public-health concerns;
government orders or directives;
requirements imposed by local authorities;
police or security instructions;
road closures;
traffic restrictions;
venue unavailability;
loss of necessary permits or approvals;
public safety concerns;
security threats;
civil disturbance;
strikes;
utility failure;
infrastructure failure;
transportation disruption;
supplier or contractor failure;
telecommunications failure;
emergencies;
acts of God; or
other circumstances outside the Organiser's reasonable control.
Where reasonably practicable, the Organiser may provide a revised date, venue, route, programme or replacement Event.
Where a postponed, rescheduled, relocated or replacement Event is provided, the participant's registration will remain valid and no refund will be payable solely because of the change.
Where the Organiser ultimately formally cancels the Event without providing a postponed, rescheduled, relocated or replacement Event, Clause 7 shall apply.
9. Registration Transfer, Sale and Substitution
Registration is personal to the registered participant.
Participants may not sell, transfer, assign, exchange, give away or permit another person to use their registration, race bib, timing device or other participant credential without the Organiser's prior written approval.
Where the Organiser allows registration transfers, the Organiser may impose:
a transfer deadline;
an administrative or processing fee;
eligibility requirements; and
any other reasonable transfer conditions.
An unauthorised participant using another person's registration or race bib may be refused entry or disqualified.
The original registered participant may also be disqualified where they knowingly permitted the unauthorised transfer.
10. Event Categories and Participant Information
The participant is responsible for registering for the correct category and providing accurate information.
The Organiser may correct, change or reassign a participant's category where reasonably necessary because of incorrect registration information, Event requirements or eligibility rules.
Any age-based category will normally be determined using the age calculation method stated in the Event information or rules.
The Organiser may request reasonable proof of identity, age, eligibility or registration at race-pack collection or at the Event.
Failure to provide requested verification may result in refusal to release the race pack, refusal of entry or disqualification.
11. Race Pack Collection
Participants must collect their race packs during the collection period and at the location announced by the Organiser unless another arrangement has been expressly approved.
Participants may be required to present:
Where collection by a representative is permitted, the Organiser may require written authorisation or other verification.
Failure to collect a race pack within the announced collection period does not entitle the participant to a refund.
The Organiser is not obliged to retain uncollected race packs indefinitely.
Uncollected race packs may be disposed of, donated, reused or otherwise handled at the Organiser's discretion after a reasonable collection period.
12. Event Merchandise and Shirt Sizes
Event merchandise, medals, shirts, race bibs, bags, gifts, products and other race-pack items are subject to availability.
Shirt sizing may differ between manufacturers, designs or production batches.
The Organiser does not guarantee that a participant's preferred shirt size, colour, design or other merchandise variation will remain available.
The Organiser may substitute an item with another reasonably comparable item if necessary because of supply, manufacturing, shipping or other operational circumstances.
Minor differences in colour, printing, dimensions, materials, packaging or design shall not entitle a participant to a refund.
13. Participant Eligibility
Each participant is responsible for determining whether they satisfy the eligibility requirements for their selected Event or category.
The Organiser may refuse entry to or disqualify a participant who:
does not meet the relevant eligibility requirements;
provides false or misleading registration information;
participates using another person's registration;
allows another person to use their registration;
fails to comply with Event rules;
presents a material safety risk; or
engages in prohibited conduct.
No refund will be provided where entry is refused or a participant is disqualified because of the participant's breach of these Terms and Conditions or Event rules.
14. HEALTH, FITNESS AND MEDICAL RESPONSIBILITY
By participating in the Event, the participant confirms that they have reasonably assessed their physical condition and consider themselves medically and physically capable of participating safely.
Participants are responsible for understanding the physical demands and risks associated with the Event.
Participants with existing medical conditions, injuries, symptoms, pregnancy, allergies or other health concerns should obtain appropriate professional medical advice before participating.
A participant should not participate where they know, or reasonably should know, that their physical or medical condition makes participation unsafe.
Participants are responsible for carrying any medication or medical identification they may reasonably require, where appropriate.
The Organiser may stop or prevent a participant from continuing where Event officials or medical personnel reasonably believe continued participation may create a serious risk to the participant or others.
Such removal shall not entitle the participant to a refund.
15. Emergency Medical Assistance
By participating, the participant authorises the Organiser, Event officials and appointed medical personnel to arrange or provide reasonable emergency first aid or medical assistance where they consider it necessary.
Where emergency transportation or external medical treatment is required, the participant may be transferred to an appropriate clinic, hospital or medical facility.
To the extent permitted by law, participants are responsible for their own medical, ambulance, hospital, treatment, insurance and related expenses.
The participant is encouraged to maintain appropriate personal medical and accident insurance.
Nothing in this clause excludes any responsibility that cannot lawfully be excluded.
16. ASSUMPTION OF ORDINARY EVENT RISKS
The participant acknowledges that participation in running, walking, sporting and mass-participation events involves inherent and ordinary risks.
These may include, depending on the Event:
fatigue;
dehydration;
heat exposure;
rain;
slippery surfaces;
uneven ground;
road conditions;
traffic;
contact with other participants;
falls;
collisions;
muscle or joint injury;
illness;
adverse weather;
interaction with members of the public; and
other risks normally associated with outdoor or sporting events.
By participating, the participant voluntarily accepts the ordinary risks reasonably associated with the Event.
This clause does not exclude or limit any liability which cannot lawfully be excluded or limited under Malaysian law.
17. Safety Instructions
Participants must follow all reasonable safety instructions issued by:
Participants must immediately stop, slow down, divert, evacuate or leave the course when lawfully instructed to do so.
The Organiser may alter or stop any portion of the Event if reasonably necessary to protect participants, staff, volunteers or members of the public.
18. Participant Conduct
Participants must behave responsibly and respectfully at all times.
Participants must not:
endanger themselves or others;
intentionally obstruct other participants;
behave violently or abusively;
harass Event personnel, volunteers, participants or members of the public;
damage property;
interfere with Event operations;
enter restricted areas without permission;
tamper with race equipment;
provide false information;
cheat;
deliberately shorten the course;
use another participant's bib or registration;
engage in unlawful conduct; or
refuse to follow lawful Event instructions.
The Organiser may refuse entry, remove or disqualify a participant who breaches this clause.
No refund will be provided following refusal of entry, removal or disqualification arising from a participant's misconduct or breach.
19. Course, Timing and Results
Where timing services are provided, timing results are subject to the proper use and operation of the relevant timing system.
The Organiser does not guarantee that every participant will receive a recorded time where a timing device:
The Organiser may correct results where there is evidence of timing error, course-cutting, incorrect category information or other result irregularity.
Unless otherwise stated, unofficial results remain subject to verification.
The Organiser may disqualify participants whose recorded data, conduct or other evidence reasonably indicates that they did not complete the required course in accordance with Event rules.
20. Medals, Prizes and Entitlements
Finisher medals, certificates, prizes or other completion entitlements may be subject to specific Event requirements.
Where stated by the Organiser, participants must complete the designated route, comply with Event rules or finish within an applicable cut-off time to qualify.
Prizes are subject to verification of eligibility and results.
The Organiser may withhold or recover a prize awarded because of incorrect information, disqualification, cheating, timing error or other material mistake.
Unless otherwise expressly stated, Event gifts and entitlements have no cash value and cannot be exchanged for cash.
21. Personal Belongings
Participants are responsible for their own property at all times.
Participants should avoid bringing unnecessary valuables to the Event.
Any baggage-deposit or storage facility provided by the Organiser is provided as a convenience and does not constitute acceptance of responsibility for the participant's belongings.
To the extent permitted by law, the Organiser shall not be responsible for personal property that is lost, misplaced, forgotten, stolen or damaged during the Event.
22. Travel, Accommodation and Other Personal Expenses
Participants are responsible for arranging and paying for their own:
transportation;
flights;
accommodation;
meals;
parking;
visas;
permits;
insurance; and
other personal expenses.
Participants are advised to consider the possibility of Event changes when making travel or accommodation arrangements.
To the extent permitted by law, the Organiser will not be responsible for losses relating to travel, accommodation or other personal arrangements resulting from postponement, rescheduling, relocation or modification of the Event.
23. PHOTOGRAPHY, VIDEO AND AUDIO RECORDING
The participant acknowledges that photography, video recording, livestreaming, audio recording and other media recording may occur during the Event.
Subject to applicable law, by participating in the Event, the participant permits the Organiser and its authorised event, media and promotional partners to capture and use photographs, video or audio recordings containing the participant's appearance for legitimate purposes connected with:
Event reporting;
Event documentation;
publicity;
promotion;
social media;
websites;
advertising of the Event or future events;
press and media coverage; and
historical or archival records.
Such materials may be edited, reproduced and published in lawful media formats.
Where required by applicable law, additional consent or notices may be obtained or provided.
Participants with specific concerns regarding photography or recording should contact the Organiser before the Event where reasonably practicable.
24. PERSONAL DATA AND PRIVACY
The Organiser may collect and process personal data reasonably required for:
registration;
payment administration;
participant verification;
Event communication;
race-pack preparation;
timing and results;
safety and emergency response;
insurance administration where applicable;
customer support;
compliance with legal or regulatory requirements;
fraud prevention;
Event operations; and
other purposes stated in the Organiser's privacy notice.
Personal data may, where reasonably necessary, be disclosed to or processed by authorised service providers such as:
Personal data will be handled in accordance with applicable Malaysian personal-data-protection laws and the Organiser's applicable privacy notice.
Participants are responsible for ensuring that personal information provided to the Organiser is accurate and up to date.
Where a participant provides another person's personal information, such as emergency-contact information, the participant confirms that they are authorised to provide that information for the relevant purpose.
25. Event Communications
The Organiser may communicate important Event information using:
email;
SMS;
WhatsApp or other messaging services;
registration-platform notifications;
social media;
the Event website; or
other official communication channels.
Participants are responsible for monitoring official Event communications.
The Organiser will not be responsible for a participant failing to receive an announcement because of incorrect contact information, spam filtering, blocked messages, unavailable telecommunications services or failure to check official communication channels.
26. Sponsors, Vendors and Third-Party Services
The Event may involve sponsors, vendors, contractors, venue operators, food providers, transport providers, registration platforms and other independent third parties.
Any separate purchase, service or transaction entered into directly between a participant and an independent third party may be subject to that third party's own terms and conditions.
To the extent permitted by law, the Organiser is not responsible for independent products or services supplied directly by third parties outside the Organiser's contractual responsibility.
27. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, the Organiser shall not be liable for indirect, incidental or consequential loss arising from participation in or attendance at the Event, including losses relating to personal travel, accommodation, missed transportation, loss of opportunity or other personal arrangements.
The participant accepts the ordinary and inherent risks reasonably associated with participating in the Event as described in these Terms and Conditions.
Nothing in these Terms and Conditions is intended to exclude, restrict or limit:
liability that cannot lawfully be excluded, restricted or limited;
statutory consumer rights that cannot lawfully be excluded; or
any other right or remedy that must remain available under Malaysian law.
28. Participant Responsibility for Breach
A participant may be responsible, to the extent permitted by law, for loss or damage directly caused by their intentional misconduct, unlawful conduct or material breach of these Terms and Conditions.
Nothing in this clause creates liability beyond what is permitted under applicable Malaysian law.
29. Event Rules
The Organiser may issue additional Event-specific rules, instructions, guides, schedules, FAQs and safety requirements.
Those requirements form part of the Event arrangements and participants must comply with them where reasonably applicable.
Where there is an inconsistency between general promotional material and these Terms and Conditions regarding refunds, postponement or cancellation, these Terms and Conditions shall apply, subject always to applicable law.
30. Changes to These Terms
The Organiser may make reasonable amendments to these Terms and Conditions where necessary to address legal, regulatory, safety, operational or Event-management requirements.
Material amendments affecting an existing registration will be communicated through the Organiser's official communication channels where reasonably practicable.
Any amendment remains subject to applicable Malaysian law.
31. No Waiver
If the Organiser does not immediately enforce any provision of these Terms and Conditions, this does not mean that the Organiser has permanently waived its right to enforce that provision.
Any waiver by the Organiser applies only to the particular circumstances in which the waiver was given unless expressly stated otherwise.
32. Severability
If any provision of these Terms and Conditions is determined by a court, tribunal or competent authority to be invalid, unlawful or unenforceable, that provision shall be interpreted or limited to the minimum extent necessary where legally possible.
The remaining provisions shall continue to apply to the extent permitted by law.
33. GOVERNING LAW
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Malaysia.
Nothing in these Terms and Conditions restricts a participant from exercising any right to bring a claim before a court, tribunal or other competent authority where such right is provided by Malaysian law.
34. FINAL ACCEPTANCE
By completing registration and payment, the participant confirms that:
they have read these Terms and Conditions;
they understand these Terms and Conditions;
they agree to comply with these Terms and Conditions and the Event rules;
the information provided during registration is accurate;
they understand the physical nature and ordinary risks of participating in the Event;
they accept responsibility for determining whether they are physically capable of participating; and
they understand and accept the Event's refund, postponement, rescheduling, relocation and cancellation policies.
IMPORTANT REGISTRATION NOTICE
REGISTRATION FEES ARE NON-REFUNDABLE.
THE ORGANISER MAY, WHERE REASONABLY NECESSARY, CHANGE THE EVENT DATE, TIME, VENUE, LOCATION, ROUTE, DISTANCE, PROGRAMME OR FORMAT, OR POSTPONE, RESCHEDULE OR RELOCATE THE EVENT.
SUCH CHANGES DO NOT CONSTITUTE EVENT CANCELLATION AND DO NOT, BY THEMSELVES, ENTITLE A PARTICIPANT TO A REFUND.
A REFUND WILL ONLY BE PROVIDED WHERE THE ORGANISER FORMALLY CANCELS THE EVENT AND DOES NOT PROVIDE A POSTPONED, RESCHEDULED, RELOCATED OR REPLACEMENT EVENT, SUBJECT TO APPLICABLE MALAYSIAN LAW.
By selecting “I Agree”, completing payment or otherwise completing registration, the participant confirms acceptance of these Terms and Conditions.
