WAIVER & RELEASE OF LIABILITY
By registering for and participating in ENERGY RUN WITH BATERIKU.COM, I acknowledge that I have read, understood and voluntarily agree to the following terms and conditions:
1. ASSUMPTION OF RISK
I acknowledge that participation in a running event involves inherent risks, including but not limited to physical injury, illness, accidents, falls, collisions, adverse weather conditions, road or venue hazards, equipment failure, traffic-related incidents and other unforeseen circumstances.
I voluntarily assume all risks associated with my participation in the event, whether such risks are known or unknown, foreseeable or unforeseeable.
2. RELEASE AND WAIVER OF LIABILITY
To the fullest extent permitted by applicable law, I hereby release, waive, discharge and agree not to hold liable the Event Organizer, its directors, officers, employees, representatives, volunteers, event crew, partners, sponsors, suppliers, contractors, venue owners and appointed service providers for any claim, demand, loss, damage, cost, expense, injury, illness, disability or death arising out of or in connection with my participation in the event.
This waiver applies to incidents occurring before, during or after the event where such incidents are connected with my participation in or presence at the event.
3. PERSONAL RESPONSIBILITY
I confirm that I am participating voluntarily and accept full responsibility for my own safety, health and well-being throughout the event.
I understand that I am responsible for ensuring that I am physically fit and medically capable of participating in the selected race category. I acknowledge that it is my responsibility to seek appropriate medical advice before participating if I have any concerns regarding my physical condition.
4. MEDICAL EMERGENCY
In the event of an accident, injury or medical emergency, I authorize the Event Organizer and/or appointed medical personnel to arrange or provide reasonable first aid, medical assistance or emergency treatment where deemed necessary.
I understand that any medical, hospital, ambulance or related expenses incurred as a result of my participation shall be my responsibility unless otherwise expressly provided by the Event Organizer.
5. PERSONAL BELONGINGS
I acknowledge that the Event Organizer shall not be responsible for any loss, theft or damage to my personal belongings, valuables, electronic devices, clothing, equipment or other property brought to or left at the event venue.
6. COMPLIANCE WITH EVENT RULES
I agree to comply with all event rules, regulations, safety instructions and directions issued by the Event Organizer, event officials, medical personnel, security personnel and relevant authorities.
I understand that the Event Organizer reserves the right to remove or disqualify any participant who fails to comply with the event rules, behaves in an unsafe or inappropriate manner, or whose participation is deemed to pose a risk to themselves or others.
7. EVENT CHANGES AND CANCELLATION
I acknowledge that the Event Organizer reserves the right to modify, postpone, suspend, relocate or cancel the event, or amend any event arrangements, categories, routes, schedules or activities, where necessary due to weather conditions, safety concerns, public health considerations, government directives, force majeure or other circumstances beyond the reasonable control of the Organizer.
8. PHOTOGRAPHY, VIDEO AND MEDIA CONSENT
I understand and agree that photographs, video recordings and other forms of media may be taken during the event.
I grant the Event Organizer and its authorized representatives permission to use my name, image, likeness and recordings captured during the event for legitimate event-related purposes, including publicity, marketing, promotional materials, social media, websites and future event promotions, without further compensation or prior approval.
9. PARTICIPANTS UNDER THE AGE OF 18
Where applicable, participation by a person under the age of 18 must be authorized by a parent or legal guardian. The parent or legal guardian acknowledges and agrees to the terms of this waiver on behalf of the minor participant and accepts responsibility for ensuring that the participant complies with the event requirements.
10. ACKNOWLEDGEMENT AND ACCEPTANCE
By selecting “YES, I AGREE” during registration, I confirm that:
* I have carefully read and understood this Waiver & Release of Liability.
* I understand the risks associated with participating in the event.
* I voluntarily accept and assume those risks.
* I agree to comply with all event rules and regulations.
* I agree to release and waive claims against the parties identified above to the fullest extent permitted by applicable law.
* I confirm that the information provided during registration is true and accurate.
* I understand that my registration and participation constitute my acceptance of these terms.
